Revenge porn: a pornografia de vingança como expressão da violência de gênero na era digital

Abstract

The present research deals with the institute of revenge pornography as an expression of gender violence in the digital age, typified by the new law n° 13.718 of 2018, which amended the text of the Penal Code to frame in the chapter "Of Crimes Against Sexual Freedom", the conducts of non-consensual disclosure of intimate images. The aim of the work is to verify how revenge pornography contributes to the control of the female body and sexuality, within this cyber field. In the face of this technological diffusion, the genesis of new relationships, such as revenge pornography have emerged, resulting in a new modality of gender violence, which reinforces women's sexual retardation and male domination. Through the deductive method and bibliographic research, it was sought to establish, first, the theoretical frameworks guiding the research, such as the conceptions of patriarchy, gender, power relations between the sexes, as well as the structural elements of gender violence. Subsequently, the sociocultural perspectives of revenge pornography on female sexuality were analyzed, listing the potentialization of contemporary conflicts through the digital society, as well as the devices of the Brazilian legal system that discipline the conduct of Revenge Porn. Finally, we verified the gender relations that reinforce the victimization of women within the criminal justice system, demonstrating the perpetuation of gender violence within the Judiciary. Therefore, it is concluded that revenge pornography is the result of a new contemporary violence that victimizes mainly women, thus corroborating its qualification as gender violence, limiting sexuality and the female body.
