| Resumo: | Em 4.7.2012, a União Europeia deu mais um passo no movimento conhecido como “Europeização do Direito Internacional Privado”, ao aprovar o Regulamento nº 650/2012, relativo às sucessões internacionais. O primeiro teste no âmbito da jurisdição comunitária deu-se no reenvio prejudicial que o Tribunal Regional de Gorzów Wielkopolski (Polônia) interpôs perante o Tribunal de Justiça da União Europeia, acerca da interpretação de disposições relativas ao âmbito de aplicação material do citado regulamento. Em particular, questionou a interpretação do tribunal acerca da lei aplicável para os efeitos de legados celebrados de acordo com a lei estrangeira. O presente estudo visa analisar o Acordão do TJUE C 218/16 – Segunda Seção. Para tanto, apresentar-se-ão os fatos do caso, as linhas gerais do Regulamento nº 650/2012 no que respeita ao seu âmbito de aplicação, bem como as relações entre a lei aplicável à sucessão e os direitos reais. Por fim, serão tecidos comentários acerca da decisão exaurida, que apresenta uma enorme carga valorativa acerca da possibilidade de planejamento em sucessões com caráter transnacional. |
| Resumen : | On July 4, 2012, the European Union took another step in the process known as “Europeization of Private International Law”, by adopting Regulation 650/2012 on international successions. The first test within the Community jurisdiction occurred in a preliminary ruling by the Gorzów Wielkopolski Regional Court (Poland) before the Court of Justice of the European Union, concerning the interpretation of provisions relating to the substantive scope of the Regulation. In particular, it questioned the Court’s interpretation of the applicable law for the effects of legacies established under foreign law. The present study aims to investigate the Decision CJEU C 218/16 - Second Section. In order to do so, the facts of the case will be presented, the general lines of Regulation 650/2012 with respect to its scope, as well as the relations between the law applicable to the succession and the rights in rem. Finally, comments will be made on the decision, which has a great value on the possibility of transnational succession planning. |
