Responsabilidade civil na violação dos direitos da personalidade através da inteligência artificial no Brasil

Abstract

This work addresses the issue of civil liability in the face of violations of personality rights resulting from the use of artificial intelligence (AI) in Brazil. The challenges of the complex interaction between technological evolution and individual rights are verified, highlighting the emerging legal and ethical challenges in this context, as explicit violations of personality rights through the use of artificial intelligence have been demonstrated, in this context there is legal uncertainty hovering over the topic, therefore, there is a need to verify the understanding of the Courts on the subject as well as verify what is being done at the legislative level, taking into account the gap that exists on the topic. The present work uses bibliographical research as a research methodology and the deductive method and seeks to highlight the importance of regulating the matter since content generated by AI has great reach on the internet, being developed and shared without any control or guidelines for its development. Furthermore, current legislation does not fully cover the magnitude of Artificial Intelligence. Therefore, this research seeks to verify whether it is possible to hold civilly responsible those who violate personality rights through AI in Brazil
