Abstract

This study is dedicated to the analysis of the legal regulation of improvements in the areas of Civil Law and Agrarian Law, focusing on their definition as improvements to properties for the purposes of conservation, improvement or beautification. A gap is identified in the understanding and application of standards related to the topic, raising the central question about possible discrepancies in the legal treatment between the two fields. The investigation considers several hypotheses, such as differences in classification, evaluation, rights and responsibilities of the parties, and specific approaches in agrarian contracts. The objectives include the analysis of the historical evolution of the regulation of improvements, the investigation of definitions and classifications in both fields of Law, the differentiation between improvements and accession, the evaluation of compensation and retention criteria, and the analysis of the relevant jurisprudence. The study highlights the importance and complexity of improvements, pointing out challenges in application and the need for greater clarity in regulations, ensuring greater legal certainty
