Propriedade intelectual nas Relações Internacionais: uma análise da proteção de direitos de propriedade intelectual na indústria da moda

Abstract

Considering the global dimension of counterfeit of goods in the Fashion Industry, the following question is asked: what is the WTO's role in the defense of intellectual property rights? And what is the relationship between Intellectual Property and the Fashion Industry? This research aims to identify the WTO's role in the defense of IP rights. The research is a qualitative, exploratory and descriptive research regarding the objectives and hypothetical deductive regarding the method. As a main premise, we believe in the importance of Trade Aspects of Intellectual Property Rights - TRIPS for International Relations. The justification of this research is the importance of studying the counterfeit phenomenon, in addition, it seeks to expand the academic production of the recent research area on IP and Fashion, denominated as fashion law. It can be concluded that the defense of IP rights within the WTO has been protected by the TRIPS agreement, noting the hypothesis elaborated at the beginning of this research. Furthermore, the multilateral IP system was established based on the interests of nations that benefited from the process of technological development and innovation. Moreover, knowledge, ideas, the creation process, etc, represent in the new dynamics of contemporary International Relations, a source of structural power, being thus of great interest to certain nations, which promote greater rigidity in the multilateral IP system.
