Impactos da dinâmica patriarcal na aplicação dos procedimentos judiciais para a proteção da vítima de violência doméstica

Abstract

This paper aims to analyze the procedures used to protect women, victims of domestic violence from a sociocultural perspective. The main objective is to analyze the possible difficulties in the application of socio-legal procedures in facing the fight against domestic violence against women, which had its late characterization, as violence in the family sphere has always existed, becoming legalized only in 2006, with the creation of the Maria da Penha Law (Law 11.340 / 2006). Throughout the work, the following bibliographical review methodology will be addressed: a) the impacts of patriarchal dynamics that hinder the application of procedures in view of the marked cultural reproduction of machismo in which society builds justifications so that men can attack women ; and b) the naturalization of violence, where the woman is inclined to accept and believe that she should be attacked for not meeting the needs of the partner who has greater economic power in the home or because, in the face of naturalization, it has always been so and etc .; and c) the possible difficulties caused by the impact of the patriarchal culture in the process of socio-legal assistance to women victims of domestic violence, such as: the lack of specialized assistance and the lack of structure so that the jurisdictional procedures aimed at the protection of women victims of violence are effectively applied.
